Counsel-review draft. This document is tailored for FamilyCase.AI but must be reviewed by qualified counsel before publication or contractual reliance.
Purpose
Define commercial and operational rules for the FamilyCase.AI platform.
Professional Use
FamilyCase.AI is a legal-technology platform for use by authorized law firms, legal professionals, approved staff, and invited clients. FamilyCase.AI is not a law firm, does not create an attorney-client relationship with clients of subscribing firms, and does not independently provide legal advice.
Attorney Responsibility
Customers are responsible for all legal advice, filings, communications, strategies, client decisions, court submissions, fee practices, trust-accounting decisions, and use of AI-generated work. No AI-generated output may be treated as final legal work without review and approval by an authorized lawyer.
Account Controls
Customers must maintain accurate user roles, disable departed users, enforce MFA where required, protect credentials, configure matter access, maintain ethical walls, and promptly report suspected unauthorized access.
Customer Data
Customers retain ownership of customer data. FamilyCase.AI receives only the rights necessary to host, process, secure, support, troubleshoot, audit, and provide the services. FamilyCase.AI does not use customer case materials to train public foundation models.
Evidence and Court Materials
FamilyCase.AI provides tools for organizing evidence, metadata, chronology, and court packets, but the customer remains responsible for admissibility, authenticity, privilege review, redaction, filing compliance, service, and court-rule compliance.
Acceptable Use
Users may not upload malware, misuse subpoenas, impersonate parties, evade access controls, use FamilyCase.AI for harassment, scrape data, reverse engineer security controls, generate knowingly false evidence, or attempt to use FamilyCase.AI for unauthorized practice of law.
Suspension
FamilyCase.AI may suspend access to protect security, comply with law, prevent harm, preserve platform integrity, or address nonpayment, subject to contractual and legal obligations to preserve customer data.
Disclaimers
AI, analytics, research, deadline, filing, and drafting features are assistive tools. They may be incomplete, inaccurate, delayed, or unsuitable for a particular jurisdiction unless verified by counsel.
Limitation of Liability
The final contract should include negotiated liability limitations, warranty disclaimers, indemnity allocations, data-processing terms, service levels, and enterprise addenda appropriate to customer segment and governing law.
Counsel Review
This draft requires review by commercial counsel, privacy counsel, state-bar ethics counsel, and payments/trust-accounting counsel before publication or contracting use.
Non-Negotiable AI Training Commitment
Customer data, uploaded evidence, legal documents, communications, privileged materials, and case materials are never used to train public foundation models.
